Terms and Conditions for Individual Bookings

1. Scope

These Terms and Conditions govern the agreement between the guest (“the Guest”) and the Eira Expeditions (“the Company”) for participation in any tour, voyage, or expedition arranged by the Company. By completing a booking and paying the deposit, the Guest acknowledges and accepts these Terms and Conditions.

2. Travel to and from the Vessel

The Guest is responsible for arranging and paying for all travel to and from the point of embarkation and disembarkation. The Company’s responsibility begins at the time of embarkation and ends upon disembarkation, unless otherwise stated in writing.

3. Booking, Deposit, and Payment

A booking is considered confirmed when the required deposit has been received by the Company.

  • The deposit is non-refundable, except where a right of withdrawal (grace period) applies under Norwegian law.
  • The balance payment must be received no later than 60 days before the start of the tour.
    Failure to pay within this period may result in cancellation of the booking without refund of the deposit.

4. Minimum Number of Participants

Each tour is subject to a minimum number of participants as specified by the Company. Should the number of booked guests fall below this minimum, the Company reserves the right to cancel the tour. In such cases, the Guest will be offered a full refund or a transfer to another departure.

5. Cancellation and Changes by the Company

The Company may cancel or alter the itinerary before or during the tour if:

  • Weather, safety, operational, or regulatory considerations make changes necessary, or
  • A situation of force majeure occurs (including but not limited to natural disasters, political unrest, pandemics, or mechanical failure).

In the event of cancellation before departure, the Guest will receive a refund of amounts paid, excluding situations of force majeure.

In cases of force majeure during the tour, the Company will endeavor to provide reasonable alternative activities or services within operational limits, but no refund will be granted.

6. Guest Insurance

The Guest must hold valid travel insurance covering:

  • Trip cancellation and interruption
  • Medical treatment and evacuation (including from ports within the tour area)
  • Accidents, injury, and death

Proof of insurance may be requested prior to departure. Participation without adequate insurance may be refused without refund.

7. Physical Condition and Participation Requirements

Participation in the Company’s tours requires a reasonable level of physical fitness, balance, and general health. The following requirements apply to all guests:

7.1 Mobility and Balance

  • Guests must be able to move safely on a moving vessel, including using stairs and narrow walkways.
  • Guests must be capable of climbing a vertical or near-vertical ladder of up to 1.5 meters between the vessel and a dinghy or small boat used for shore landings.
  • Guests must be able to step in and out of a dinghy or small boat without assistance under normal conditions.

7.2 Stamina and Stability

  • Guests should be able to walk for 2–3 hours on uneven terrain during shore excursions, while carrying a light personal pack.
  • Guests should be able to stand for periods of up to 30 minutes and maintain balance on a moving deck or during small-boat transfers.

7.3 General Health

  • Participation requires general good health without medical conditions that could be aggravated by physical activity, vessel motion, or limited medical access.
  • Guests with chronic conditions (heart, respiratory, diabetes, mobility issues) should consult a physician before booking.
  • Any condition requiring regular medication or attention must be disclosed to the Company before departure.

7.4 Seasickness

  • Sea conditions may vary, and motion sickness can occur even in calm weather.
  • Guests prone to seasickness are advised to bring suitable medication and use it preventively as advised by a physician.
  • Refunds or compensation will not be provided for missed activities due to seasickness.

7.5 Participation and Responsibility

  • The guides and captain have full authority to limit participation in activities if a guest’s condition or ability is deemed unsafe.
  • Failure to meet these requirements may result in exclusion from certain activities or, in severe cases, from the entire tour without refund.

8. Language and Communication

All Guests must be able to communicate in English, the declared tour language, or one of the Scandinavian languages. Failure to do so may affect safety and participation.

9. Conduct and Safety on Board

Guests must comply at all times with instructions from the guides and crew.

  • The Captain holds the ultimate authority on board and has the right to take any measures necessary to ensure safety and order.
  • The Company may disembark any Guest whose behavior endangers the safety, welfare, or enjoyment of others.

10. Alcohol and Drugs

  • Alcohol is available for sale on board. Guests may not bring their own alcoholic beverages.
  • The possession or use of illegal drugs is strictly prohibited.
    Violation of this rule may result in the Guest being put ashore at the nearest safe port, without refund or further obligation on the part of the Company.

11. Complaints

Any complaint regarding the tour must be made in writing to the Company within 7 days after the end of the tour. Complaints received after this period may not be considered.

12. Limitation of Liability

The Company’s liability is limited to what is required under Norwegian law. The Company is not responsible for indirect losses, consequential damages, or events beyond its reasonable control.

13. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Norwegian law. Any dispute arising out of or in connection with this agreement shall be settled by the courts of Nord-Troms and Senja municipal court.
